Seoul Semiconductor Patent Case Wins Million Dollars


Seoul Semiconductor (Seoul Semiconductor Co., Ltd.), a manufacturer of light-emitting diode (LED) environmental protection lighting technology, announced that Seoul High Court (Korea) decided on October 24 that Seoul Semiconductor’s appeal won and successfully overthrew the Seoul Central District Court (SeoulCentralDistrictCourt) Dismissed the ruling of Seoul Semiconductor to appeal to Korean LED manufacturer ITSWELL. The Seoul High Court ruled on October 24 that ITSWELL would indemnify Seoul Semiconductor for a loss of $1.2 million.

As early as 2005, Seoul Semiconductor filed a ban on South Korea's ITSWELL and Advanced Optoelectronic Technology Inc. (AOT), requesting to stop infringement of Seoul Semiconductor's white LED patent rights. Winner of the Korean Intellectual Property Court (KoreanIntellectualTribunal). The Seoul High Court’s ruling was followed by the October 1995 issue of the Korean Patent Court (thePatentCourtofKorea) dismissing the complaints filed by ITSWELL and AOT, attempting to overturn the Korean Intellectual Property Magistrate’s ruling and demanding the patent of Seoul Semiconductor White LED. The production right was invalid, but the complaint was not accepted by the magistrates' court and it was decided to maintain the original judgment. Seoul Semiconductor was found guilty. The judgment of the Korean Patent Court clearly confirmed the originality and validity of Seoul Semiconductor's white LED; and the judgment of the Seoul High Court further consolidated the patent production rights of Seoul Semiconductor White LED.

In 2005, Seoul Semiconductor filed a preliminary ban on AOT’s patent infringement of Seoul’s semiconductor white LEDs in the Central District Court of Seoul, and it has won the case, and AOT has also waived its appeal.

In response to a ban on the infringement of its patent for white LEDs by Seoul Semiconductor, AOT and ITSWELL filed counterclaims, respectively arguing to the Korean Intellectual Property Magistrates Court, the Taiwan Intellectual Property Magistrates Court and the Korean Patent Court that Seoul Semiconductor’s white LED environmental protection patent technology is not Original, but all the claims that invalidated the patent production rights of Seoul Semiconductor were rejected by the Magistrates' Court, and Seoul Semiconductor was ruled to win the case.
