Xi'an City Night Lighting Management Measures


The first one is to strengthen the city night lighting management, beautify the city night scene, display the new image of the city with historical and cultural features and modernization, promote economic development, and formulate these measures in accordance with relevant regulations and the actual conditions of the city.

Article 2 The following buildings (structures) or places within the administrative areas of Xincheng District, Beilin District, Lianhu District, Yanta District, Weiyang District and Yongqiao District (hereinafter referred to as the District) of this Municipality shall be set in accordance with the provisions of these Measures. City night lighting:

(1) Buildings (structures) on both sides of the main street of the city;

(2) The city has extensively tasted bridges and cultural relics;

(3) Urban landmark construction (structure);

(4) Street signs and commercial thresholds of major streets;

(5) Other facilities that require lighting.

The scope of the main street of the city is determined by the municipal administrative department.

Article 3 The term “city night lighting” as used in these Measures refers to the lighting and beautification of urban night scenery by using lighting facilities and technology.

Article 4 The night illumination of the city shall follow the principles of unified planning, scientific setting, outstanding features, and harmony and beauty.

Article 5 The municipal administrative department of administration is the competent department of the city's urban night lighting work.

The district people's government is specifically responsible for the organization, implementation and management of urban night lighting in its administrative area.

The High-tech Industrial Development Zone, Economic and Technological Development Zone, and Qujiang New District Management Committee are specifically responsible for the organization and implementation of night lighting in the area.



Article 6 The departments of planning, construction, cultural relics, gardens, public security, civil affairs, and electric power shall, in accordance with their respective duties, cooperate with the city's night lighting and management.

Article 7 The urban night lighting construction plan shall be incorporated into the overall urban planning.

The urban night lighting planning shall be prepared by the municipal planning administrative department in conjunction with the municipal administrative department. After being evaluated by the expert committee and reported to the municipal people's government for approval, the municipal administrative department shall organize the implementation.

The urban night lighting zoning plan is prepared by the district people's government and the development zone management committee according to the city's night lighting plan, and reported to the municipal municipal administrative department for the record. In the zoning plan, the main avenues should adhere to the principle of unification of prosperity and characteristics; for the night lighting planning of each building (structure), it is necessary to adhere to the principle of not only highlighting the architectural style but also coordinating with the environment.

Article 8 The night lighting facilities of newly built or rebuilt buildings (structures) or urban squares must be designed, constructed and put into use at the same time as the main project.

Article 9 The night lighting facilities of the city shall be funded by the owners or management units of the building (structure) and shall be responsible for the daily maintenance and management of the facilities, and maintain the integrity, function and appearance of the urban night lighting facilities.

Article 10 The design and construction of urban night lighting facilities shall comply with the technical specifications and operating procedures for the installation of lighting facilities.

Urban night lighting design schemes for large-scale, iconic buildings (structures) and important cultural relics should be implemented after being approved by the expert review committee.

The expert review committee is composed of experts from relevant parties.

Article 11 The setting of urban night lighting facilities shall comply with the following provisions:

(1) The pattern, shape and specification ratio are coordinated with the building (structure) and the surrounding environment;

(2) Adopting new technologies, new processes, new materials, and new light sources;

(3) It meets the requirements of environmental protection and has safety facilities such as fire prevention, wind protection and leakage prevention.



Article 12 The electricity consumption of electricity used in urban night lighting facilities shall be preferentially implemented, and the electricity fee shall be charged according to the street lamp electricity fee standard.

Article 13 It is forbidden to arbitrarily deactivate, change, move or dismantle urban night lighting facilities.

Article 14 The municipal administrative department of the municipality may establish a central night lighting control center control system according to actual conditions, and implement central control on the opening and closing of urban night lighting facilities.

Article 15 The opening time of the night lighting facilities is the street light opening time.

The closing time of night lighting facilities is as follows:

(1) From June to October each year: no earlier than 24:00;

(2) From November to May of the following year: no earlier than 23:00;

(3) New Year's Day, Spring Festival, International Labor Day, National Day holiday and major events: no earlier than 1 am the next day.

Article 16 Anyone who violates the provisions of these Measures and fails to set up night lighting facilities shall be ordered to make corrections within a time limit; if they refuse to make corrections, they shall be organized and set up by the people's government of the relevant district or the management committee of the development zone, and the expenses shall be borne by the owner or the management unit.

Article 17 Anyone who commits one of the following acts in violation of the provisions of these Measures shall be ordered to make corrections and shall be fined not less than 500 yuan but not more than 1,000 yuan:

(1) arbitrarily changing, moving or dismantling night lighting facilities;

(2) The urban night lighting facilities are not opened or closed as required.



Article 18 If a party is dissatisfied with the decision on administrative punishment, it may apply for administrative reconsideration or file an administrative lawsuit according to law.

Article 19 Anyone who obstructs the staff of the relevant administrative department in performing official duties shall be dealt with by the public security organ in accordance with the Regulations of the People's Republic of China on Public Security Administration Punishment; if a crime is constituted, criminal responsibility shall be investigated according to law.

Article 20 If the staff of the municipal administrative department and other administrative departments engage in malpractice for personal gains, neglect their duties or abuse their powers, they shall be given administrative sanctions by the unit or the competent department at a higher level; if they constitute a crime, they shall be investigated for criminal responsibility according to law.

Article 21 The municipal municipal administrative departments shall commend and reward units and individuals that have made outstanding achievements in the planning, construction and management of urban night lighting.

Article 22 The people's governments of Yanliang District, Linyi District, Chang'an District and municipal districts may refer to these Measures in accordance with local actual conditions.

Article 23 These Measures shall come into force on December 10, 2003.
